Former federal prosecutor Andrew McCarthy argued on Friday that Special Counsel Jack Smith had effectively confirmed that the prosecutions of President-elect Donald Trump were politically motivated. 

U.S. District Judge Tanya Chutkan approved Smith's request to remove deadlines in the federal election interference case on Friday. McCarthy pointed out that Trump's victory in the November 5 election rendered the prosecutions increasingly untenable.

“They’re acknowledging the longstanding guidance from the Office of Legal Counsel at the Justice Department, which essentially states that a sitting president cannot be indicted or prosecuted,” McCarthy told *America Reports* co-host Sandra Smith. “They’re conceding that President-elect Trump will be certified at the joint session of Congress, scheduled for January 6th. His victory will be formally ratified, state-certified electoral votes will be confirmed, and by January 20th, he will effectively be a sitting president. Under those circumstances, they are arguing that the cases should not proceed.”
